These terms and conditions refer to the open market programmes on the website www.nebs.nl of the New Energy Business School – Part of New Energy Coalition (hereinafter referred to as “New Energy Business School”, “NEBS” or “we”). These terms and conditions apply to the agreement between the participant (student) and the organisation with which the participant enters into the (training course) agreement.

Article 1. General

These General Terms and Conditions apply to all offers, quotations, and agreements of the New Energy Business School (NEBS) concerning the provision of services, including but not limited to training programs, seminars, workshops, conferences, summer courses, and master programs. By enrolling, the participant agrees to these terms. NEBS reserves the right to correct typographical or printing errors. 

Article 2. Enrollment

Enrollment is done via the NEBS website unless otherwise stated. If the website is temporarily unavailable or if otherwise agreed, enrollment is also possible via email. The agreement is concluded upon confirmation of enrollment by email from NEBS. Placement is based on the order of registration. If placement is not possible, the participant will be notified. The agreement is concluded with the individual participant, not their employer. The participant remains fully responsible for complete and timely payment, even if the invoice is paid by an employer. NEBS reserves the right to refuse enrollments without stating a reason. 

Article 3. Prices

All prices, unless stated otherwise, include training materials and catering but exclude 21% VAT. Travel and accommodation costs are not included. NEBS reserves the right to change prices. Once confirmed, the price remains valid unless the course is rescheduled to a later date. 

Article 4. Payment Terms

The participant must pay the full course fee within the payment term stated on the invoice. If payment is not made on time, NEBS has the right to withhold or terminate the agreement, with the cancellation fees from Article 5 applying. 

Article 5. Cancellation by Participant

Participants may be replaced by another participant at no extra cost, provided this is reported in advance in writing. Cancellation must be made in writing or via email and is subject to the following fees: • Cancellation up to 30 days before the start: €75 administration fee plus non-refundable costs already incurred. • Cancellation 15 to 29 days before the start: 50% of the course fee. • Cancellation less than 15 days before the start: 100% of the course fee. 

Article 6. Cancellation or Amendments

NEBS reserves the right to make changes to the content, structure, instructors, materials, dates, times, or locations of a course, or to cancel it without stating a reason. If NEBS cancels a course, the participant will receive a full refund. In case of changes by NEBS, the participant has the right to cancel within 14 days at no cost. 

Article 7. Complaints Procedure

Complaints must be submitted in writing to NEBS within 14 days of the event. The complainant will receive an acknowledgment of receipt within 5 working days. Complaints will be handled confidentially and resolved within 4 weeks. A complaint does not exempt the participant from payment obligations. 

Article 8. Liability

NEBS strives for the highest quality in its services but cannot guarantee that all information provided is error-free. NEBS is not liable for incorrect information provided by instructors or course materials unless in cases of intent or gross negligence. Liability is limited to direct damage and to a maximum of the amount the participant paid for the course. Additional liability clause: NEBS disclaims all responsibility and liability for damage, injury, loss, or other unforeseen circumstances during participation in its activities, both nationally and internationally. Participants take part at their own risk and must arrange appropriate travel and personal insurance. 

Article 9. Force Majeure

If NEBS is unable to perform (part of) the agreed services due to force majeure, it has the right to suspend or partially/fully terminate the agreement without compensation. Force majeure includes, among others, illness or death of instructors, as well as unforeseen weather or traffic conditions. 

Article 10. Processing of Personal Data

Upon enrollment, personal data is processed for participant lists and administrative purposes. This data is treated confidentially and only shared if necessary for the execution of the agreement or due to legal obligations. NEBS complies with the General Data Protection Regulation (GDPR). Participants have the right to access and request a copy of their data. 

Article 11. Continuing Education 

Participants receive a certificate of attendance if they have attended at least 80% of the course and signed the attendance list. Unless stated otherwise, NEBS courses are not registered programs of a recognized educational institution. 

Article 12. Intellectual Property

It is not permitted to reproduce, publish, or exploit course materials or other information from NEBS in whole or in part without permission. Recording video or audio during courses is prohibited. NEBS or the instructor retains the copyright on course materials unless otherwise stated. 

Article 13. Applicable Law

All agreements with NEBS are governed by Dutch law. Disputes will be submitted to the competent court in the Northern Netherlands.
